I tryed to run from police the other day but caught. But anyways I have a question, ok so right now I have a criminal trespassing in the third degree charge filed against me, I'm a minor so is there anway I can just pay a fine or will I end up with fucking gay community service?

This is what I read..Criminal trespass in the third degree is a class 3 misdemeanor. At most you could get a fine of up to $500, a year of probation, and a year of banishment from the property. It didnt say anything about community service. I would imagine youll get off with a low fine...if they do give you community service...I reckon it would be around 10-20 hours.

say your asking a random person a question, if you don't play their audio, but have them clearly on the footage, do you need their permission?
post #67
13 June 2005, 01:01 UTC#67
Yeah you need their permission.
post #68
13 June 2005, 01:15 UTC#68
Does the permission always have to be written?

I was wondering if I got on tape someone saying it was alrignt, could that be enough?
post #69
13 June 2005, 01:19 UTC#69
That would be good enough. Someone could always try and sue you...but they would never win if you had videotape of them consenting.

Yeah, that's what I was thinking. Thanks.

ok, what are the laws aboot graffitti?

Can you film someone taging something and not show their face, and then not have legal reprocussions?

Aboot nudity
Say you videotaped someones tits w/ someone else writing your name on their tittays. Would I need like a waiver showing their 18? or could I just put little smiley faces over their nips and not get hit up by the legal system?

It is difficult for a DA to prosecute based soley on video evidence. They need witnesses, victims, dates, times, locations, etc. They could try to prosecute, but considering its a misdeameanor crime...it would be a waste of their time unless they were confident they could win...

As for nudity. Not sure where you live, but in the US...federal laws do not demand record keeping on content that does not contain sexual explicit conduct.

Federal Law defines Sexually Explicit Conduct as:

(b) Penetration of the vagina or rectum by any object;

© Masturbation;

(d) Sadomasochistic abuse for the purpose of sexual stimulation of the viewer;

(e) Exhibition of the genitals or unclothed pubic or rectal areas of any minor, or the unclothed breast of a female minor, for the purpose of sexual stimulation of the viewer;

(f) Defecation or urination for the purpose of sexual stimulation of the viewer; and

(g) Touching of a person's clothed or unclothed genitals, pubic area, buttocks, or breast area for the purpose of sexual stimulation of the viewer.

So to answer your question, I think you would be okay to put titties in your video. Keep in kind they need to be 18 or over.

thats a part of the law that has either not yet been defined....or that I have not yet read up on.

All I know is that you can legally put clips of girls tits in videos without having to keep record. And if Im wrong...then many videos...such ass bumfights, indecline, and cky have all broken the law...as they all show clips of topless woman and have no 2257 compliance statement on their site.

A 2257 compliance statement will look like this, and you can find them on almost every adult website that features explicit conduct..

I guess u could set the camera to show the date on the film and change your camera date to July 2, 1995

so, if I get someone on tape taging something, and dont show there face, and I wait a while for any concern for it to blow over, im good.

And if I have a clip of a girls nips, its all good, because I can just find someone that is 18 that will say that it was theirs.

Now about puting the nudity into a dvd, do I need a warning, do I need a disclaimer.
post #78
13 June 2005, 02:36 UTC#78
uh I dont know about a disclaimer..that would be civil..like lawsuit shit.

And I wouldnt put video of an underage chicks tits in your dvd...even if you got someone to cover you. Filming it one thing, but selling and distributing it is another. If you were to get caught...they could charge you with every dvd you sold...and the penalty would add up and up. You would be royally fucked. So every dvd you sold would be 1 count of that crime, and if the penalty max was say..10 years...and you sold 10 dvds...and you were given the max pentalty...well you would die in prison.

Also....with tagging...if no charges are made within 1 year of the date the crime took place..you dont have to worry about it. Every crime has a statute of limititations, which puts a time limit on how long a DA has to bring forth charges. I believe 1 year is the statute of limitations for misdeameanors...I would check with someone who knows to be sure...as it different in every state. What you want to know is "statute of limitations on misdeamenor vandalism".

This isnt really about filming because I'm not sure if I'm going to film it yet. But I was wondering was charges can be pressed on me if I beat the crap out of some guy. Becuase I'm sure he will call the cops.

You know that can depend on how bad you beat the guy up I think. Could be assault all the way up to attempted murder.

If there's a chance he'll call the cops, its simple. Don't film it

So the least they can do is probably charge me with assault? Then I'll be sure not to film it.

Well, if you beat someone up..no matter how lightly, it is by law classed as assault, so its kinda obvious :P
