I hope they do read my posts. Im not just starting trouble for the sake of it. It pisses me off that this guy can come in here with a shit deal and try to rip groups off.

All of you groups have worked hard and got some awesome content, dont sell yourselves cheap. This guy just wants your footage, then he may give you 50 bucks 2 years down the track and keep 99% of the money. Money that he made off your backs.

I say again, dont anyone go into one on one emails with this guy, he is good with words and will scam you very quickly. Keep it out in the open and keep your points coming.

As I said, I put in a few points in the license that he needs to look at to make it look "less" dodgy than it is and he didnt even reply to any of the points I raised.

Michael, Im not paranoid.. But when a producer offeres a total budget of 10% off "NET" profit in return for a WHOLE dvd full of content I smell bullshit and ripoff. You know as well as me you should be offering a lot more than that.

see even if he changed the contract the fact that he put that in there knowing it was a shit deal makes me not want to believe or work with this guy

I suggest you guys give suggestions as to how I can make the deal workable and good for you guys. I want every group in here involved in the production. All I ask is that you guys be fair with your requests but share your suggestions.

Quarterly royalty statements posted to all groups involved "hard copy"

This will include all units sold and where.

I wouldn't sell the rights to the DVD to XEG. I rather get my own distribution deals, I don't need them.

Other than that, I can't go higher than 25% due to production costs, legal fees - lawyers, then the entertainment lawyer takes a % for getting it distribution. I seriously can't go higher than that.

There won't be any debt. There won't be any problems like this. If worse came to worse and I sold the rights (which will never happen) I would still give you guys 20-25%.

It's unprofessional. This is how I run my show. Contracts serve one purpose, to cover the owners ass. You dont give the participant any rights. When our hookers request certain terms, (IE they want their face blurred out)...we work on a good faith basis. We give them our word. We dont change our contract for them. They are the participant. If they dont like it, they dont participate. Although Moody's situation is obviously a bit different. But you get the idea.

His contract is indeed non-exlusive. Although it's unspecific as to what projects he's using that footage for...im sure he would add that on if someone asked.

The 10% profit share is sketchy. No one should be doing this for the money. Do it for the plug. Profit shares are complicated. If money is a big issue here, I reccomend that Moody buys footage up front from the groups he has chosen to use. Based on how much Bumfights offers...I think he should pay $100-$300 per 5 minutes of footage used.

if it blows up like he thinks it will, which im not shure of, it would be worth the money, and the groups would get paid as well

and weak there is a difference between you paying hookers to fuck on film and people giving up there footage for money

but it was a funny analogy

exactly, when you do your dvds it's mostly you filming footage

his dvd is soley based on the footage of other groups thats why his contract should flex or mold to fit the "reasonable" demands of the groups
