as long as the footage is sent by August 1st, everything will work out. just don't send it later than that.

I'll start working on changing the release form now for you guys.

Really quick note... If you send me previously edited footage, you MUST remove all music from the footage. that is very very important.

Here's the new contract. I added the 10% revenue share and also the group name and website plug in clause number 4...

1) I, (______________________________) represent (__________) and all individuals included in any and all videos, films, photographs and/or recordings that have been submitted by myself or another active or inactive member of our organization to Michael Moody, his agents and employees, and any and all individuals included in any and all videos, films, photographs and/or recordings have agreed to let me represent them and sign this contract to legally release any and all personal rights to these examples of any and all individuals included in any and all submitted videos, films, photographs and/or recordings and allow Michael Moody to copyright the production in which my footage has been used but I remain the owner of my original footage.

2) I, (_______________________________) do hereby state that any and all individuals under the age of 18 that are included in any and all videos, films, photographs and/or recordings that have been submitted by myself or another active or inactive member of our organization to Michael Moody, has had their parent and/or guardian directly give me permission to represent them and sign this contract to legally release any and all personal rights to these examples of their child and/or foster child in any and all submitted videos, films, photographs and/or recordings that have been submitted to Michael Moody.

3) I, ( ______________________________) represent (___________) and do hereby give permission and grant all rights to Michael Moody, his agents, employees, assigns, clients, and/or distributors, to copyright the finished production my footage is used in, advertise, sell and release to the general public or any other party in any other country in the world, any and all videos, films, photographs and/or recordings that may be included in during any one of their productions and I hereby release any and all personal rights to these examples of myself and the other individuals represented in any and all videos, films, photographs and/or recordings that have been submitted by myself or another active or inactive member of our organization to Michael Moody, his agents and employees but I remain the owner of the original footage.

4) I, (______________________________) represent (____________) and it has previously come to an agreement with Michael Moody that all groups will receive their name and website plugged in the DVD and any group that submits footage and has their footage used in the DVD will receive an equal amount of the 10% of revenue from the DVD that will be divided evenly amongst the involved groups.

5) I, ( ), do further state that I am over eighteen (18) years of age.

6) I, ( ), do further understand that should either party hereto or any heir, personal or representative, successor or assignee of either party hereto, resort to litigation to enforce this agreement the party or parties prevailing in such litigation shall be entitled, in addition to such other relief as any be granted, to recover its or his reasonable attorney’s fees and costs in such litigation from the party or parties whom enforcement was sought.

so do u just want loads of separate clips, or do u want them all together. if we get rid of the music, we'd have to get rid of all sound... that not a problem?

You have your footage on mini DVs? Just copy your footage to a mini DV and sent that and they will edit it for the DVD. If you wanna edit by yourself then edit it without music and burn to a DVD or mini DV and sent that

Fair call but 10% is nothing.. If anything the budget for content should be up around 30-40% at least. The fact that he is making a DVD from other peoples material ie: doesnt have to pay actors, location fees, equipment hire etc etc makes it very attractive.

Fuck that.. Net revenue means shit. You need to be offering "gross" if anything. You will easily be able to rip off the groups with net. Basically the 10% is after all of his costs and time. He could more or less put in an hourly rate for himself of 100USD, deduct that from the profit thats come in off the DVD and only THEN take 10% off the money left (still leaving him with 90% of the profit plus all the money he took out to make it)

To all groups considering this, It is my reccomendation that you dont deal with this guy. He was caught out in a lie the other day in that thread that got deleted and has a really bad reputation. Its not worth lining this guys pocket for a few hits on your website. You wont get the exposure he's promising and I doubt you'll ever see a cent from this guy.

I know all the groups on here dont do this for money, but making this guy rich by ripping off all your content is lame.

There's better ways to get exposure, trust me.

I don't have a bad reputation. Elliot might not think highly of me but that's as far as that goes. My rep is good and I have a lot of productions going on with famous individuals so I would take that with a grain of salt. I didn't get caugt in a lie the other day. I was asked "if I was the guy that was making the skate video."

I never made a skate video so that question confused me. The post that it was referenced to was over a year old and out of my memory.

I could be in contact with all the groups that submit footage when the DVD is released but I will need everybody that submits footage to supply me an email stating their group name, group website and email and then I can stay in touch with you. Without that information I won't be able to let you know when the DVD is released without using this message board.

Do gross revenue of 40% with a 3 year license, the license will only cover this production. In the new license please put a section that allows groups to audit at 2 week notice.

I dont have anything personal with you, I dont even know you.

All I know is that in the past you've tried to exploit groups and take them for a ride.

The fact that you want to take the discussion into email more or less cements that you want to fuck people over.

Keep it in the public forum, where everyone can see your responses and interject. Its a lot easier to hide your bullshit in one on one emails.

If anyones got any questions for him you're probably better posting them here, dont contact this guy directly until he agrees to some resonable terms in public.

yeah some are being dicks, but elliot is just pointing out the flaws in this deal

and negotiating a better contract, so I hope you not refering to elliot

I would also like to have weak take a look at this contract as well, but im glad elliot posted his imput he is a producer and has produced the pickled eggs dvd an has his own media company and he is a homegrowner as well, so I would listen to what he has to say
