I just remembered a story someone posted here awhile back about the owner of a Chinese restaurant confiscating someone’s camera.

I'm gonna fill you in on some laws and I'm gonna tell you how to solve this problem.

LAWS 1

First, no one has the right to take your camera away except the police. Civilians sometimes think they can take it from you if your using it for mischief, but they’re wrong. They cant. Period. It doesn’t matter if you’re on their property or on public property. Nothing ever gives them the right to seize your equipment.

LAWS 2

If someone takes your camera away from you and refuses to return it, this would classify as theft. If your camera is worth $500+, this would then classify as Felony Theft.

If you witness someone committing a felony, the law grants you the right to detain them and put them under citizen's arrest.

Even if your camera isn't worth $500+, if you witness the crime, you are usually permitted to apprehend the perpetrator.

WHAT TO DO 1

Some parts of the following are not completely legal, but I don't care. I'm going to absolutely recommend this. This is what I would/will do, and this is what you should do -

Purchase Pepper Spray ASAP, and make a habit of carrying it with you everywhere you go, especially when filming. Aside from school, you're allowed to bring with you virtually anywhere.

If someone take your camera from you, say and do the following:

- Order them to give you back the camera immediately.

- Inform them that they have committed Felony Theft (most cameras have an MSRP in the $500 range) , and that you’re putting them under citizens arrest.

- Don't waste anytime. You say those 2 lines and them move in for the kill. Take out your pepper spray and unload, try and go for a surprise attack to keep them from defending themselves.

- They'll fall to the ground and most likely have a difficult time breathing. Take back your camera, and kick them in the stomach while they’re down. Don’t hold back from spitting on them either.

Once you have your camera back, bone out. Don’t call the cops. Just get out of there.

CONCLUSION

If you wanna keep it legal but still get your camera back, use the Pepper Spray and leave out the violence.

Don’t be case sensitive. Don't discriminate. I don’t care if its a boy, girl, or grandma. They don’t have the right to take your shit, and if they have to learn the hard way so be it.

I'm 100% serious about all of this. Buy Pepper Spray. It's inexpensive and it will absolutely come in handy.

Anyone who does this has my complete respect, and I'd be more than happy to give you a free FUKT shirt & DVD. This is a real problem, and it's important you take action.

Your think most of that goes for the Uk too?

Are we allowed to use pepper spray? I dont know :(

im gonna go get some pepper spray asap, right after I get some money

but when you put someone under citenzen's arrest arn't you only aloud to say "I am putting you under citzen's arrest" and hope they co operate?

if not can you show me the part of the law that says I can apprehend them with pepper spray?

Yeah I'd like to know if this applies for the UK too.

I had a video about how to deal with the police on US laws. They were saying they are not allowed to search you unless you have done something suspicious eg. they can smell weed NOT if you just look like you may have some.

Plus if your car is unlocked, they are free to search it. If it's locked then they can't get you to open it without reason.

Another is that if you get pulled over and they asked you what you think you were doing wrong, don't say anything as you would be pretty much admitting it.

Or something :/

haha...dude for a free dvd id purposely piss somebody off to the point they try and take my camera...getting to spray someone w/ pepper spray and kicking the shit out of them is well worth it.

This was very funny... and the fact its a fact itself makes it even better!

I don't think I'll go for the violent option... but pepper spray would come in handy.. Image file not present in the recovered backup

LOL, I got myself some pepperspray, carry it wherever I go cause its on my house keys. I've never had to use it yet, but I can't wait till someone fucks with me.

conclusion -

it all depends on the situation and cirumstances on whether or not youll get in trouble for this. It depends on the manner everything was carried out. Bottomline, dont do this if you cant get away with it. If the police get involved, you could make a decent case for yourself, but it's not worth the risk. And by getting away...I mean the person not knowing who you are, and no one having your license plate number, and being able to bone out before cops come.

If you are caught, what I think realistically would happen is they would press charges against you, and you would press charges against him, and then youd both drop charges cause your both at fault.

I still stick to what I said, and when the opportunity arises, I will definitley be getting my camera back from whatever dumb shit tries to take it from me.

But realisticly, im never going to have pepper spray on me, so would pepper spray be in the same assault charge as a punch to the face? I would guess it would be worse.?

Word, all you gotta do is put it right on your keychain. I totally reccomend punching them as well. But dont do it on the basis that the law is on your side. It is a fact that in the states its illegal for a civillian confinscate someones personal property, but as to what type of action your permitted to take against the perpetrator in vague.

Im just saying....if some chinese bitch didnt want me filming in her store, and snatched by cam out of my hands, I wouldnt tell her to give it back, I wouldnt call the cops, I would straight up go up to her and grab out of her hands no matter what it took. If I had to pin the bitch down so be it. And if she grabbed on the LCD display or something, shed probally break it off, and I swear Id break her fucking nose.

Keep in mind in CKY4 when the security guard tried to take Bams board...Mike Valley came straight up and pushed the fucker against the wall and got his board back. Thats how you gotta do it.

The only that I recall someone taking my camera was this prank where I set up the cam on a bike path and pretended to be injured. The guy saw the cam and just picked it up and took the tape out and tried to walk away with it once he knew it was a prank. I didnt know the law back then, and I was only 15, but I tried to intimidate him tell him that I have friends down the path who wont let him get away. haha. He gave it back, but onyl because his face wasnt show in it. He wanted me to tape over it and shit. I swear though dude, nowadays, I would even hesitate. You cant hesitate. You just gotta take back whats yours.

I dont have a keychain. But yeah I would totally punch someone, or run them over or some shit.

Heh, someone stole fools weed once so he drove into them, it was lol. They fully flew onto the bonnet haha, damn I wish I had my camera that night.

definitely buy it from ebay...cheap and easy. If you want to buy it locally, go to your local arms dealer, or Big 5.

For finnish members: In finland you need permit for pepperspray, otherwise its as bad as illegal gun. And you really cant get the permit, you need good reason for it, work as a guard etc. you need to take a course for it and they look after how you use it, you have to check the spray in once in a while and so on.....

But! Sprays are easy to get in estonia, and trip costs like 19e! Go there and do some smugling.... biggrin.gif

one time I was talking to a cop and I turned on the light and the cop got pissed told me to turn it of, I said no he said fine ill make you and grabbed the camera I grabbed it back and walked off.
