Music samples in songs

ok so iv been collecting music for the retardz projects and these underground unsigned artist have sampled film scores and other audio from films or other artists work but edited it and changed it so its not a basic stealing a beat.

now if I was to use a song witch featured a sample and the composer somehow found my dvd

who would get in trouble? the artist or me

the artist would of sign the rights to me to use it in the project

also sound effects. I hear the same SFX of automatic doors sliding up like 'ssswwoosshhh' in TV,Movies and video games...are these free to use? or does someone own them? because somewhere I have a cd with everysound effect from every resident evil & silent hill games ever made. thats a fucking lot so is it worth me listening out for SFX for our skits? or could I be asked to remove them or get sued at a later date if found by who ever owns them


I know its a long shot but I want to make this dvd as legally made as poss

I don't really think that the door things are much different. Since its a generic sound, and it can be recreated without knowing it. How much are they gonna really make you pay to use a whoosh, lol, thats sad. anyways. thats my take on it.

I was just using the whoosh as an eg. because its the one I hear alot of. I mean there is going to be 1000s of sound fx on the cd. do you think they copywriten as someone had to of recorded them for somthing

I think it would be the artists fualt and u could just say u were mislead. and sound effects can be copywritten, movies sounds I think can be used as long as there not like trademarked not too sure though ive heard them in a lot of songs.

I have a few friends that are directors in CA and one told me that if the sound clip is under 30 seconds and you give credit, then you do not need a release/permission to use forms. That however, may only be helpful to those here in the states. But from what he says, if it's under 30 seconds, credit it and it's fair game, if not, baracade your door shut so they can't come after you. Hope this helped.

If the artist signs a release, the artist would get in trouble. Because that release form is saying that they are the rights holder to that music. The release form would free you of liability...just make sure its a legit release form.

im not sure about the sound effects question, my guess is you would be alright. I dont see how anyone could sue you for using a sound.
