I was just wondering if anyone know any legalities whith filming. Like what is legal and illegal, like if I were to burn the hair of my friend that was passed out. Because the cops have the tape. And other shit like fights and crap.

on the note of cops taking tapes did they give you back that tape of me getting my assed kicked yet Al? if so you can still use it for whatever an if u still need an interview im cool with it.

I think I heard that you can just film whatever you want just as long as you dont instigate it. But I dont really know what the fuck that means.

how the fuck do the cops get their hands on your footage anyway?
You can avoid this by
a: running
b: not letting them get their hands on your camera
c: beating them down

setting you friends hair on fire would be assault with deadly force. It is illegal, but in order to be prosecuted the victim would need to press charges.

What Ray meant by instigate is its legal to film so long as you are not activley involved or responsible for the crime taking a place. When youre filming a crime, make yourself a spectator rather than a participant, like a reporter. That should keep you safe.

lets just say it's not good to have any fights on camera, if your face is in the video you can still get in trouble becuz it's just like them witnessing you do it right in front of them. also, filming in public, beleive it or not is illegal, your supposed to have a permit to be able to film in public or where ever, they just haven't been to strict on it considering tourists do it all the time. and if you are about to get caught by the cops just don't run, it will make it worse and then they have the right to take the video cam but if you keep it kool they will just ask questions and leave you alone.

They could try you as an accomplice depending on the situation, but in the end you would come up on top. Not sure about NZ law though.

In the US, if police had video of my friend tagging and knew his name, it would be difficult to successfuly prosecute him for vandalism without a formal police complaint. And that formal complaint would have to be made within the statute of limitations. There are so many loops holes in the legal system. The majority of prosecutions are succesful because people either confess when being questioned or plead guilty and except a plea bargain.

And I would ignore Justins post. It isnt very good advice in my opinion.

maybe so, but freinds mom is a lawyer and she tells me that the cops won't do anything if you comply with what they have to say, if they feal that for some reason that something suspicous is going on then they will react for that situation and do what they feel is right, but in the end, FUCK COPS!!!

u can say they need a warrant to search your bag.. so put the cam and/or tape in your bag when they come.

Ok weak, if I were to film a fight what could I do to make it legal to put on my site?

Don't wanna get any shit, I could blur faces and pretend it was random people, would that keep me safe?

Here is a pretty through answer.

What youre talking about would be a civil matter, not criminal, because it's dealing with the rights of private citizens. So if someone was to take this up with you legally, you wouldnt be criminally prosecuted. They would take you to civil court to either sue you or make you take the video down.

Keep in mind they would have to hire a lawyer, which would be expensive. Before taking you to court, their lawyer will send you a cease and desist letter., asking you take down the content, and threatening to take legal action if you don't comply. If you comply, you'll be off the hook.

Now if you were to film a fight it could be deemed newsworthy, especially if it was in public. If it was considered newsworthy, you would not need consent forms or to blur faces.

Newsworthy is defined as - Of sufficient interest or importance to the public to warrant reporting in the media.

I wouldnt worry about it man. Even if someone was to hire a lawyer and go through all this shit, and you content wasnt considered newsworthy (which is unlikely), you would still, at worst, only get a warning. Remember, what you are doing isnt criminal.

We got snapped by the police the other night.

I wasnt filming luckly, the undercover cop was chsing me while I was driving, I thought it was just a angry meber of the public so I started boosting and went through a red light.... ah he wasnt too pleased about the tagging or my driving.
