ok, so here's what happened.

we were driving around squirting randoms with water guns. we were on our way home and we just saw one more dude and sprayed, barely even got him wet. little did we know there was a cop behind us, so we got pulled. the dude was a fucking dick. "I can charge you with assault with a deadly weapon, blah blah blah" I wanted to fucking go off on him, but Eric was the one shooting and it was his GL2 we was filming with, and I didn't wanna make shit worse than it was. in the end, the douchebag conviscated the tape and the water gun we used.

I think this guy fucked up bigtime. first of all, the dude we sprayed caught up to us, Eric apologized and the guy said he didn't wanna press charges or anything. it should be done then right? no, the guy took the gun we used to spray and nearly fucked up Eric's cam with his dumbass trying to get the tape out. he said it was "evidence". but for what!?!?!? there was nothing to prove, I don't think he had any right to take the fucking tape, but once again, I wasn't the one getting in trouble and I didn't want to make shit worse than it was for Eric. then the fucking guy took my water gun. he fucked up with that because 1.) he never saw me use it for anything and 2.) he didn't report it (he gave us a receipt of some shit he conviscated) so yeah, this guy is fucked and I am getting that tape back one way or the other.

haha this may sound weak or cool, but mommy dearest is going to go downtown in the morning and raise hell.

p.s. what's the advice? carry a dummy tape. if a cop pulls you switch them out, then you won't have to worry about getting a tape taken with good footage on it.

That's actually a good idea. Squirting people with waterguns, however, is very rude & inconsiderate. Shame on you.

omgz yates, you got that poor man wet. what ever will he do? dreams, hopes, and goals all shattered right before his eyes.

he had no right to take that shit. you should have stepped up man. I would have.

Yeah dude, thats a really good idea actually. When the cop took my cam I just snuck into the cop car and broke it.

Shouldn't this be in the legal section, Yates? hmm....

Haha, I used too do that with my brother and his freind, good times :D
Sucks about the tape though.

Edit: Nvm, read it proper now.

First off, pointing any sort of gun out of a car window, whether it is a real gun or a water gun is a crime in of itself.

To strike someone or somthing with anything thrown, projected ect out of a moving vehical is a crime as well.

Lastly, if a cop confiscates your camera, hes going to check to see if your tape contains anything on it, and if he is taking your tape you have been charged with a crime and your body and belongings will then have been searched revealing any other tapes you may have.

Word's idea was good, but in in NZ the police cars do not have the barrior between the back seat and front seat, so he was able to reach in front. All police cars in the united states have the barrior in them (national law in police safty) which would prevent you from getting to it as the officer wouldnt leave it in back with you.

And oh ya, destorying or hiding evidence to a crime is a felony.

Advice: dont shoot or throw shit out of car windows and think its legal, and dont destory or hide evidence.

unless you filled out an evidence form, u prolly wont get that tape back. if they just took your names .chances are theres no paperwork at all. but if u remember the officers name, u can prolly track him down or report him or something.

heres my advice if someones in this situation. but theres variables, so go with what u think is best.
if the footage is really amazing and worth possibly being in a bit of shit, you shouldnt of turned off the camera at any point when the cops arrive. if your totally innocent, nothing will happen.
also u could of just taken the charge(most likey just a threat), and it had to of gone in evidence.
they might want u to just delete a part, cops dont know cameras. ive salvaged a decent part of a tape by fast forwarding instead of recording when I realized the po's had no idea. but still if my freind and I could go back we both would of taken the charge.

if the footage wasnt that great, just do whatever they want u to.

but good luck dude and if u dont get the tape back, at least u didnt get in trouble.

Cops do know cameras and dont take it under assumption they dont, I just finished an advanced training course on recovering evidence from digital media. And this is a common training course for police officers all over the nation.

If he kept the footage and there is no intention of taking it further then that is bullshit. Kick up a fuss and get that shit back.

Not in Siloam? I trick cops all the time, same with security dudes and shit.

Just act like your really pissed you broke your cam or the tape wont play and they usually believe you.

cop intelligence varies, they're smarter in cities and towns prone to higher crime.

like here, there's hardly any robberies, and murders and etc. the cops here are fucking retarded

It depends on the seriousness of the crime, for example, in Minnesota if a husband beats the wife, I HAVE to take him to jail, even if the wife wont press charges. Its a pretty serious crime when your pointing guns out of car windows, fake or not.

I confiscate things on a daily basis without pressing charges. Like the other night, I had someone pulled over and I they had a pipe and a baggie of pot that I saw on the floor. I gave them the choice of getting a ticket, or watching me dump the pot out on the side of the road and breaking the pipe. Same thing with minor drinking parties. We take the booze and dont write tickets.

Sounds like this dude is just trying to scare you, but if he does decide to turn it in the evidence is right there, and these days with crime getting so high tech police are keeping up with knowing about cameras, computers, digital cameras, mp3 players (yes, even they can hold incriminating information), palm pilots, and basically anything that can hold information. All I was trying to say is dont rely on just rewinding a video tape and thinking the cop wont look at it, or wont search you and your things for other tapes.

PS: sorry for the late reply I was sleeping

hmm speaking of mp3 players... wouldn't it be a fairly nasty occurance if you got stopped in the middle of the street and your ipod/ other mp3 player confiscated because the officer had a suspicion that you had copywrited material on it?

would they be able to do this?
as I think the majority of people who have mp3 players, do NOT pay for their mp3's

why would a cop do that anyway? over mp3's? that's a waste of paperwork.

but anyway, you're saying if I held out a green pistol, see through, and full of water.. that'd be a crime?

If they did they need to get a warrant to take property from you if they have not witnessed a crime. If they wanted to get a warrant they would have to provide evidence of the case they want to charge you for. This isn't done with mp3 players because the police don't know for sure that it is copyright material on there even if it is highly likely.

However I did hear a story about a guy who had downloaded a SOAD album before it came out, and a cop had heard it as he was walking past and knocked on his door. Can't remember what happened though.

Nope, if I can verbally articulate how I suspected there is evidence to a crime in a digital media device, and I can verbally explain how I would suspect that you would delete the information while I was obtaining a warrant, I dont need one.

This pertains to everything, say I go to a house and knock on the door to talk to some people about a crime, and I can hear them breaking things or scuffling, I can come in without a warrant because if I were to go get one, the evidence that would be relevant to the case would be destroyed or gone.

It actually is very concrete, the supreme court is the one who made the ruling that it would be legal for a search without a warrant under those circumstances.

so, do you think there is a chance we can get our tape back?
