looking at things from a legal entertainment point of view...

u have a case for sure but e! has insurance for this kind of stuff, so yikers will get hit the hardest, e!'s liability insurance will cover their accident to you most likely. in the lawsuit, u have a few different charges because depending on how good your lawyer is, he can push the card that not only did they use the footage, but they were derrogatory, possibly leading some viewers to think that the guy that took the lights to the nuts really did have a "sex change" even though it was just a poorly written joke.


now also, any big time company that buys or liceneses footage has it signed off by the seller that they are not responsible for any 3rd parties claims about footage or money owed, etc. which could make suing e! much harder unless you can prove they knew that yikers didn't own the copyright to the footage. e! will have their butt covered.

I dont mind with internet, but the fact that they didnt ask me at all before airing the footage is what made me mad, I would have given it for free, But I am a firm beliver of giving credit when credit is due...and its mother fuckin due.
