Yes I know this clip is old, but I wanted to share this with dgodlewski. This is what I was talking about with people thinking they have the right to take your camera and tapes. The lady claims they are trespassing. Is she the owner of the shared parking lot? Is she even an on-duty worker? Does she have the right to tell these people to leave? Is their presence even considered tresspassing? In the clip I see them doing nothing illegal or wrong. They could have been skateboarding, but even then..that would only be an infraction.

So lets give the bitch the benefit of the doubt. They are tresspassing, this lady is the owner, and the guys there are doing something "illegal". By law, what can this bitch do?

Do workers and security guards even know this shit? No. They dont. They have no fucking clue what the laws are. And that is exactly why the scenario depicted in this video are far from rare. It's all too common that some dumb fuck tries to take matters into their own hands and seize your equipment. And its fucking bullshit.

Deal with these people whatever works best for you, you all know how I deal with these fucks. I treat anyone who attempts to take my camera as a thief committing robbery.

First off, I think I have covered the legality of trespassing in as much detail as I can in the post about confiscating cameras, so those interested in that read that thread in the legal section.

Secondly, no the women in THIS particular case did not have the right to take the camera. Remember, every single case is different and the incidents surrounding it are as well. I cant comment on one case and say "it is this way all the time." It is incredibly hard to take something as broad as trespassing and condense it down into one single piece of advice. That’s why the legal system is so complicated and lawyers are able to charge the rates they are for advice lol. And to be totally honest, I have only dealt with serious trespassing issues like 2 times and both were assault cases as well, so the assault was the focus of the crime not the trespassing. My advice was drawn from what I learned in school, what I learned on while training on the job and research of Minnesota Criminal code on trespassing and use of force, as well as other sources to confirm all of it.

It boils down to this, private property is just that..priavte. If you come on the property to commit a felony in most jurisdictions that constitutes the owner may legally use force to remove you and confiscate any evidence pertaining to that crime (ie. video of it) as long as that person turns it into police immediately.

Now with that said, from what I have dealt with 8 times out of 10 nothing is going to happen to you unless your doing something pretty serious. And in my book kids fucking around is not a serious offence. I will come and tell you to leave and tell the property owner to calm the fuck down. If they don’t call the police right away, how you deal with them is up to you. I was just giving a point by point assessment of what could happen to you in the confiscating cameras thread. I’m not saying it WILL happen, but it can and I only think its fair when giving legal advice I give the worst case scenario so people know the full implications of their actions. This is just my advice, you can take it or leave it and no skin off my back either way.

As for your source weak, I love wikpedia for most things but not for legal issues as you can see from the quote on the site:

I didnt make this thread to challenge your opinion, but to show you the reality of what I was talking about. Not many people here commit felonies, and when they do....they usually dont stick around on the property...but I agree with what you said as a worst case scenario.

And while Wikpedia may not be a very reliable source, you and I both know that quote is pretty accurate.

Anyways, I just wanted to give you a better idea of the scenarios I was talking about in the other thread awhile back. You seemed to have the wrong idea about it.

Oh I didn’t take that as a challenge at all dude. The only thing I hate about these boards is you cant put voice inflection in typed words to say something in a friendly tone . But ya like I said, its hard to give legal advice on a broad topic without specific case related information, and in the case above, your 100% correct that the women had no right to do what she did.

In the UK, will I get fined by diving into a vending machine. It didn't break or anything. What about annoying a person by calling them shit with a cam in their face?

To be honest dude, I know absolutly nothing about laws in the UK. Sorry...I can look into it but it would only be quotes from my research and not actual working knowlage.
