ok while watching Law & Order SVU, I heard this information about requiring waivers from strangers in videos. A guy tape himself having sex with girls and posted it on the internet. When they tried to sue him, he won the case since he wasn't selling the footage. So if we plan not to sell the footage we don't have to get signed release form or don't have to censor out there face correct?

You have to understand that anyone can try to sue you for anything. Im not saying they'll win...but...it will always be a possibility.

If you put videos on the net of people who did not give consent...their best chance at successfully suing you would be to argue that the video you put of them on the net damaged their image.

If its just random people walking by I wouldnt worry about. If its paris hilton naked...I would think twice.

so would something like this be considered ruining there image ...its the last clip, cause if I can get away with posting it for free I'll take off the face censors.

Weak is right. They can only win a case against you if they prove to the judge that you defamed their image.

If you are in a public place, and have bystanders on tape, you dont need a waiver off them.

It gets a bit trickyer if you directly involve them in the video some way though.

To my knowledge, if you record someone without their consent, you cant get in trouble, if there is no audio. Because some dude in like lousiana, recorded a tenant, in the shower, and changing and shit, but he won because there was no audio, and no breach of privacy. Thats all I know.

I think that case had to do with him setting up the video camera on his own property. That law doesnt apply to anything homegrown as far as I know.
